Overview
Crypto.com’s New York suit, filed June 2026 against the Attorney General and the Gaming Commission and pleaded as a constitutional challenge to the state statutes. It is one of three prediction-market preemption cases running in the Southern District at once, alongside Kalshi’s and Novig’s, and it is the furthest along of the two that are still live at the district level.
The preliminary-injunction motion was filed in June 2026 and fully briefed by August 17. The court set a hearing for September 14, 2026. On August 31 the state filed the Ninth Circuit’s three August 28 decisions — Assad, Crypto.com’s own Nevada loss, and Robinhood’s — as supplemental authority against the motion.
