3. Not Financial or Investment Advice

TickerTracker provides market analytics and data visualization tools for prediction markets. Nothing on this platform constitutes financial advice, investment advice, trading advice, or gambling advice.

  • TickerTracker does not recommend, endorse, or suggest any particular trade, position, or market outcome.

4. Subscriptions and Payments

  • Services are currently free to use.
  • When paid subscriptions are enabled, payments will be processed securely through Stripe.
  • Subscriptions will auto-renew unless canceled before the renewal date.
  • All payments are non-refundable unless required by law.

5. Availability and Downtime

We make no guarantees regarding the availability, uptime, or reliability of the Services. Services may be interrupted, suspended, or terminated at any time without notice.

6. Intellectual Property

All content, data, and materials available through the Services are owned by TickerTracker or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from our content without prior written consent.

Market data displayed on the Services is sourced from third-party prediction market platforms, including Kalshi, Inc. and Polymarket. TickerTracker does not own or control this underlying market data. Your use of such data is subject to the terms and conditions of the originating platforms.

Team names, league names, logos, and other sports-related trademarks referenced on the Services are the property of their respective owners and are used for identification and informational purposes only. TickerTracker is not affiliated with, endorsed by, or sponsored by any sports league, team, or governing body.

7. Termination of Accounts

We reserve the right, at our sole discretion, to suspend or terminate your account or access to the Services at any time, without notice, for any reason, including but not limited to violation of these Terms.

8. Disclaimer of Warranties

Our Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and data accuracy.

9. Limitation of Liability

To the maximum extent permitted by law:

  • TickerTracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use.
  • Our total liability to you for any claim arising out of or relating to the Services shall not exceed the amount you paid to us for the Services in the twelve (12) months preceding the claim (or $50 if you have not made any payments).

10. Indemnification

You agree to indemnify and hold harmless TickerTracker and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of your use of the Services or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of North Carolina.

Arbitration: Any dispute arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association. The arbitration shall take place on an individual basis; class actions and class arbitrations are not permitted.

Waiver of Jury Trial: By agreeing to arbitration, you waive any right to a jury trial.
