Overview
The earliest of the three prediction-market suits against Washington’s regulators, filed March 2026 as a complaint for permanent injunction and declaratory relief — months before Crypto.com’s and Novig’s, both of which noticed it as related. It never reached a merits ruling. On May 21, 2026 Judge John C. Coughenour granted a stipulated motion concerning enforcement actions and administratively stayed the case pending the Ninth Circuit’s decision and the occurrence of the first of a set of conditions agreed between the parties.
The order sets its own clock: within ten days of the Ninth Circuit decision and the first condition the parties must confer, and within twenty days file a status report. The Ninth Circuit decided Assad — and Robinhood’s own Nevada appeal — on August 28, 2026. Whether that started the clock depends on the agreed conditions, which are not visible on the face of the public docket.

The case is reassigned from Judge Cartwright to Judge Coughenour, who later takes both parallel prediction-market suits against the same defendants.
May 2026
Judge Coughenour grants a stipulated order concerning enforcement and administratively stays the case pending the Ninth Circuit.
What's next: A status report is due within twenty days of the Ninth Circuit decision and the first of the agreed conditions. Kalshi’s September 9, 2026 petition for rehearing en banc in Assad keeps that decision from becoming final, and the public docket shows no status report yet.
