Overview
Polymarket US’s exchange entity sued the Attorney General, the five Gaming Commission members and its executive director on February 9, 2026, three days after the Suffolk Superior Court entered its preliminary injunction against Kalshi. It never filed its injunction motion. The parties negotiated instead, and on March 5, 2026 Judge William G. Young entered their joint stipulation and administratively closed the case until Kalshi has exhausted its state appellate rights on that injunction.
The stipulation’s terms: the Attorney General will bring no civil or criminal enforcement action over the sports event contracts Polymarket US lists until at least 14 days after the stay ends, and the Commission members, who represented that they cannot bring enforcement actions without the Attorney General’s approval, were dismissed without prejudice. If the Supreme Judicial Court decides Kalshi’s appeal on direct review, the stay ends when it issues its opinion. Novig’s Massachusetts suit was stayed on the same condition five months later.
