Overview
Novig’s Massachusetts suit, filed August 2026 against the Attorney General and the full Gaming Commission, went dormant within three weeks — and the terms of the stay are the interesting part. On August 24, 2026 Judge F. Dennis Saylor IV granted a joint motion staying the case until KalshiEX LLC has exhausted its state appellate rights on the preliminary injunction the Suffolk Superior Court entered in the Commonwealth’s enforcement action against Kalshi — specifically, until the Massachusetts Supreme Judicial Court affirms or reverses that injunction.
That is a federal court expressly sequencing itself behind a state supreme court, on a question the Third and Ninth Circuits have already answered in opposite directions. It also means Novig’s Massachusetts exposure is now a function of a case Novig is not a party to.
