Overview

Separate from the federal preemption appeal (KalshiEX LLC v. Schuler), the Ohio Casino Control Commission moved to levy a $5 million fine against Kalshi, and Kalshi sued in the Franklin County Court of Common Pleas on June 29, 2026 to block it, relying among other claims on the Ohio Constitution’s right to a civil jury trial. The federal case no longer shields Kalshi: on September 25, 2026 the Sixth Circuit affirmed the denial of its injunction against Ohio. The state-court challenge is pending.     We said the CFTC and 39 states plus D.C. filed on opposite sides of Kalshi’s Ohio fine challenge. They did not: the CFTC’s brief was in the federal Sixth Circuit appeal, and the multistate brief was in Massachusetts. Removed.
