The fifth and last of Novig’s August 2026 filings, and the boldest of them: Wisconsin is the one state where a federal judge has already rejected this exact preemption argument. Judge Griesbach denied the United States and the CFTC a preliminary injunction there in July 2026, and that ruling is on appeal to the Seventh Circuit. Novig sued the Attorney General and the Division of Gaming administrator anyway, in the Western District — a different district from the CFTC’s Eastern District case, so a different judge. Defendants were served in late August; no ruling.
