Overview
Attorney General Peter Neronha sued Kalshi and Polymarket (May 2026) for unlawfully conducting sports wagering. The state suit was removed to federal court as State of Rhode Island v. KalshiEX LLC; QCX LLC d/b/a Polymarket US (D.R.I. No. 1:26-cv-00333) — Polymarket US is a co-defendant in it. Hours before the state filed, Kalshi had brought its own preemption suit, KalshiEx LLC v. Furcolo (No. 1:26-cv-00327), and the United States and the CFTC intervened in that one. The two dockets are now formally consolidated before Chief Judge McElroy, who heard all three preliminary-injunction motions on August 3, 2026; the decision is pending. Correction
Rhode Island’s case is formally consolidated with Kalshi’s own suit before Chief Judge McElroy, and Polymarket US is a co-defendant in it. We had described three parallel tracks and a separate CFTC suit; the CFTC intervened rather than suing.
AG Neronha sues Kalshi and Polymarket US; Kalshi had filed its own federal suit hours earlier, and the United States and the CFTC intervene in it about a week later.
