Kalshi filed a pre-emptive suit (February 2026) seeking a declaration that Utah’s gambling law is preempted (KalshiEX LLC v. Cox). In August 2026 the court denied that relief and granted Utah summary judgment, holding the federal law Kalshi relied on does not preempt the state’s anti-gambling enforcement. Unlike most entries in this tracker, this is a merits judgment rather than a preliminary ruling. Kalshi filed a notice of appeal to the Tenth Circuit (No. 26-4100) on August 5, 2026 and moved for an injunction pending appeal.
